Terms and Conditions of Sale and Delivery

General
Offers, deliveries and performances are carried out exclusively under these Terms and Conditions of Sale and Delivery unless other agreements were made expressly and in writing. The buyer’s conditions of purchase are only binding to the extent that they do not conflict with these Terms and Conditions or were expressly acknowledged and confirmed in writing.

I. Delivery obligations
1. The written acknowledgement of an order shall be relevant for the scope of delivery. Additional agreements and amendments require the written confirmation of COSLINE Cosmetics. Part deliveries are permissible.
2. Disruptions and events of force majeure entitle COSLINE to extend the agreed delivery time and, if the specific circumstances require this, to rescind the delivery obligations as a whole or in part.
3. Information given in brochures and illustrations are not mandatorily relevant; changes to or perfection of COSLINE goods are permissible.

II. Offer
The documentation pertinent to the offer, such as illustrations and drawings, is only approximately relevant unless it was expressly designated as binding. COSLINE shall reserve the copyright to this documentation.

III. Prices and payments
1. The prices listed in the price list of COSLINE Cosmetics are quoted in Australian Dollars and as gross prices including GST. By issuing the current price list all previous price lists and offers lose their validity.
2. Unless an agreement to the contrary was made, prices are from the place of business of COSLINE’s establishment plus postage and handling.
3. A shipping fee of $7.90 for Regular Parcel Post or $9.90 for Express Parcel Post shall be charged regardless of the number of items shipped. All shipments are sent via Registered Post which requires a signature on receipt of goods.

IV. Payment methods
COSLINE Cosmetics has set up a range of payment options to suit everyone. We currently accept credit cards which enables our customers to provide their credit card details via our secure website. We accept Visa and Mastercard. If you would prefer an alternative, you can pay by direct bank deposit (see account details listed), or by money order issued by Australia Post (please post to COSLINE Cosmetics Australia, PO Box 289, Winston Hills NSW 2153). In these cases, the order will only be sent once payment has been received.

V. Reservation of ownership
The delivered goods shall remain the property of COSLINE Cosmetics until the purchasing price is paid in full.

VI. Delivery time
The delivery time is one week from receipt of payment and applies subject to unforeseeable obstacles.

VII. Items that are not available
If a certain item is not available, COSLINE undertakes to inform you of this unavailability prior to accepting the order. In such cases COSLINE Cosmetics reserves the right to send you a substitute item which is equivalent in price and quality.

VIII. Dispatch and passing of risk
Delivery is made by post. Any complaints about damage, loss or delay must be reported immediately to COSLINE.

IX. Returns and Refunds
Should a product arrive faulty or damaged, please contact us within 7 days of receipt of your order either by phone on 0404 044 044 or by email at info (AT) cosline.com.au * (please refer to the notice below), and we will issue you with an authority number once we have assessed the reason for the return. Once you have been issued with your authority number please return the products urgently quoting the authority number and reason for the refund/exchange by secure post to COSLINE Cosmetics Australia, PO Box 289, Winston Hills NSW 2153, where you will be provided with either a full refund, or a replacement at no extra cost to you. We are unable however to refund or exchange due to a change of mind.
Please note that we cannot refund the Shipping costs and you must pay for any costs involved in returning the products to COSLINE Cosmetics.

COSLINE Cosmetics is not under any obligation to replace any defective items as long as the buyer is in default of his or her payment obligations.

X. Other agreements
If individual provisions of these General Terms and Conditions are legally ineffective, this shall not affect the validity of the remaining provisions. The legally ineffective provision shall be replaced by such a provision that comes as closest as possible to its commercial meaning.
